A Deed of Gift is an instrument of property transfer from a property owner (the Donor) to another person (the Donee) without any payment (in cash or kind) received from the Donee.
When an individual wants to give a land or house as a gift to his father, mother, brother, sister, relative, friend, church, club, association or anyone at all, the proper instrument of property transfer is a Deed of Gift.
A Governorβs Consent is to be obtained on the transfer at the Lands Bureau of the State where the property is located. Consent Fee, Stamp Duty and Registration Fees will be paid. However, there will be no Capital Gains Tax to be paid as there was no payment made by the Donee for the property.
